“Bands on Track 2017”
Terms and Conditions
By submitting your Expression Of Interest (EOI) to “Bands on Track 2017”, you and your Artist (Band) are agreeing to the following terms and conditions:
Information on how to submit the EOI forms a part of these terms.
WHO CAN SUBMIT?
Subject to this clause, the EOI is open to all Bands.
At least 50% of each Band must be resident in South Australia, and that Band member or those Band members must make a substantial contribution to the Band’s performance.
Bands are not eligible to submit an EOI if the Band or any member of the Band is a director, officer, or employee of South Australian Music Contemporary Music Company Limited (Music SA).
HOW TO SUBMIT AN EXPRESSION OF INTEREST (EOI)
EOI submission commences online on Thursday 10 November at 10.00 am Adelaide time, and closes on Monday 28 November at 11:59 pm Adelaide time.
The Band must complete in full the EOI form available online at www.bandsontrack.com.au
The member of the Band submitting the EOI warrants that he or she is authorised by each other member of the Band to accept these terms and conditions on behalf of the Band and each of its members.
Incomplete EOIs and EOIs received after the close on Thursday 28 November at 11:59 pm Adelaide time will be ineligible.
All rights in the EOI become and remain the property of Music SA and will not be returned to the Band. Music SA has the right to use, and to authorise other parties to use, the information in any manner whatsoever. Entry into the process constitutes consent to any such use without attribution or payment of any fee or further consideration. For the avoidance of doubt, the Accompanying Materials are not subject to this sub-clause.
The Band grants to Music SA a perpetual, non-exclusive, royalty free licence to use and authorise other parties to use the Accompanying Materials in any manner whatsoever for a period of six (6) months from date of application. An EOI submission constitutes consent to any such use without attribution or payment of any fee or further consideration.
Each Band entering an EOI agrees that Music SA, Clipsal 500 Adelaide, and their licensees may:
use the name and likeness of the Band and each of its members for such promotional purposes as it sees fit;
film performances by the Band, and such footage may be edited, broadcast or distributed as Music SA, Clipsal 500 Adelaide, and their licensees see fit.
Nothing in these terms and conditions requires Music SA to use any EOI, including the winning EOIs, for any purpose.
Failure to comply with these terms and conditions and all reasonable directions of Music SA and Clipsal 500 Adelaide may result in a Band being disqualified from the process.
Based on information contained in the EOI, Music SA will select Six (6) Bands to participate in concerts held as part of the 2017 Clipsal 500 Adelaide event.
The performance opportunities are:

Unless expressly stated in these terms and conditions all other expenses, including any travel or accommodation expenses, become the responsibility of the selected Bands.
Bands agree to participate and co-operate as required in all editorial activities relating to the promotion of the concert events, including but not limited to being interviewed, filmed and photographed. Each member of a selected Band agrees to grant Music SA a perpetual and exclusive licence to use such footage and photographs in all media worldwide and acknowledges that the Band will not be entitled to any fee or further consideration for such use.
The date, time and location of the event are not negotiable. Bands must make themselves available on the date communicated. Bands unavailable on the date, time and location will be deemed ineligible.
The performance opportunity relates to the 2017 Clipsal 500 Adelaide concert series only and cannot be transferred or redeemed for cash.
Clipsal 500 Adelaide and Music SA may add, withdraw, reschedule or substitute artists and / or vary the event program at its sole discretion.
Bands agree to comply with all directions issued by Clipsal 500 Adelaide and Music SA in relation to their Clipsal 500 performance.
Where possible bands will be supplied with a standard backline at the Event. Each Band is responsible for providing any other equipment it may require for its performance at an Event.
Any Band utilising samples which may be the subject of copyright must provide to Music SA a list of the samples it intends to use as part of its performance in the Event, at least one week prior to the date of the Event.
It is a condition of accepting the performance that each member of the Band may be required to sign a legal release in a form determined by Clipsal 500 Adelaide in its absolute discretion.
Music SA and Clipsal 500, and their contractors, employees, directors, officers and agents will not be liable for any claim, loss, damage, injury, cost or expense of any nature whatsoever (including but not limited to consequential loss) which may occur as a result of, or is in any way connected to, the EOI (including but not limited to its variation or cancellation).
Music SA and Clipsal 500 will take no responsibility for EOIs unable to be submitted, or EOIs submitted but not received.
Music SA reserves the right to add to, remove, modify, or otherwise change any part of the process, including the applicable terms and conditions, in whole or in part, at any time. Changes will be effective when notice of such change is posted at the Bands On Track website, www.bandsontrack.com.au. Please check these Competition terms and conditions frequently for updates. If any term, condition, or change thereto is not acceptable to you or your Band, you should contact Music SA immediately in writing.
